WHOIS ID Protection Terms and Service

This WHOIS ID Protection Terms and Service ("Agreement") outlines the terms under which CloudWorks 360 provides WHOIS ID Protection services to you, the registrant ("Registrant"). By enabling WHOIS ID Protection for your domain name, you agree to comply with the following terms and conditions set forth by CloudWorks 360 and our Authorised Registrar.

 

1. Definitions

  • WHOIS ID Protection: A service that masks the personal contact information of the Registrant in the public WHOIS database, replacing it with generic contact information provided by CloudWorks 360 or our Authorised Registrar.
  • Registrant: The individual or entity that holds the rights to a registered domain name and opts to use WHOIS ID Protection services.
  • Authorised Registrar: The entity authorized to provide domain registration and WHOIS ID Protection services on behalf of CloudWorks 360.

 

2. Service Description

WHOIS ID Protection is a service provided by CloudWorks 360 that replaces the Registrant's personal information in the public WHOIS database with alternate contact details. This service is designed to protect the Registrant’s privacy and reduce the risk of unsolicited communications, identity theft, and fraud.

 

3. Registrant's Obligations

The Registrant agrees to:

  • Accurate Information: Provide and maintain accurate contact information with CloudWorks 360. Even though the WHOIS information is masked, the Registrant's actual contact details must be up-to-date in our records.
  • Responsiveness: Respond promptly to any inquiries or notifications sent by CloudWorks 360 regarding the domain name. The Registrant understands that CloudWorks 360 may relay important communications received through the WHOIS-protected email or postal address.

 

4. Exclusions and Limitations

WHOIS ID Protection does not:

  • Mask Information for Certain TLDs: Not all domain extensions (TLDs) support WHOIS ID Protection. The Registrant acknowledges that this service may not be available for certain domains.
  • Prevent All Unsolicited Communications: While WHOIS ID Protection reduces the visibility of personal information, it cannot eliminate the possibility of receiving unsolicited emails or other communications.
  • Substitute for Legal Compliance: The Registrant remains responsible for complying with all applicable laws and regulations related to domain registration and ownership, regardless of whether WHOIS ID Protection is enabled.

 

5. Disclosure of Information

CloudWorks 360 may be required to disclose the Registrant's actual contact information under certain circumstances, including but not limited to:

  • Legal Requirements: Compliance with court orders, subpoenas, or other legal processes.
  • ICANN Policies: Adherence to ICANN regulations or requests from authorized authorities.
  • Fraudulent Activity: Investigation of potential fraudulent activity, abuse, or breach of terms related to the domain name.

 

6. Service Suspension or Termination

CloudWorks 360 reserves the right to suspend or terminate WHOIS ID Protection services for the following reasons:

  • Non-Payment: Failure to pay for the WHOIS ID Protection service.
  • Abuse or Misuse: Use of the service for unlawful purposes, including but not limited to spam, phishing, or other forms of online abuse.
  • Violation of Terms: Breach of this Agreement or any other applicable CloudWorks 360 policy.

 

7. Limitation of Liability

CloudWorks 360 and its Authorised Registrar shall not be liable for any loss or damages, whether direct, indirect, incidental, or consequential, arising from the use or inability to use WHOIS ID Protection services, including but not limited to the accidental or unauthorized disclosure of the Registrant's personal information.

 

8. Amendments

CloudWorks 360 reserves the right to amend this Agreement at any time. Any amendments will be effective upon posting on the CloudWorks 360 website, and continued use of WHOIS ID Protection services by the Registrant after such posting constitutes acceptance of the revised Agreement.
