This gTLD Registrant Agreement ("Agreement") is a binding contract between you, the registrant ("Registrant"), and CloudWorks 360. By registering a generic top-level domain (gTLD) through CloudWorks 360, you agree to the following terms and conditions as set forth by our Authorised Registrar. These terms are necessary to ensure compliance with the policies established by the Internet Corporation for Assigned Names and Numbers (ICANN) and other applicable regulatory authorities.
1. Definitions
- Authorised Registrar: The entity authorized to provide domain registration services for gTLDs on behalf of CloudWorks 360.
- Registrant: The individual or entity registering a gTLD through CloudWorks 360.
- Registry: The operator responsible for managing and maintaining a specific gTLD domain name system.
- ICANN: The Internet Corporation for Assigned Names and Numbers, the organization responsible for coordinating the global domain name system.
2. Registrant's Obligations
The Registrant agrees to:
- Provide Accurate Information: The Registrant must provide complete and accurate information during the domain registration process. Failure to do so may result in the suspension or cancellation of the domain name.
- Maintain Up-to-Date Contact Information: The Registrant is responsible for ensuring that all contact information associated with the domain name registration is current and accurate at all times.
- Compliance with ICANN Policies: The Registrant agrees to comply with all applicable ICANN policies, including but not limited to the Uniform Domain Name Dispute Resolution Policy (UDRP) and other requirements set by the relevant Registry.
3. Authorised Registrar’s Obligations
The Authorised Registrar is responsible for:
- Domain Name Registration: Processing the Registrant's application for a gTLD in accordance with the policies established by ICANN and the relevant Registry.
- Renewals and Transfers: Facilitating the renewal and transfer of gTLDs in compliance with applicable policies.
4. Dispute Resolution
The Registrant agrees to be bound by the Uniform Domain Name Dispute Resolution Policy (UDRP) and any other applicable dispute resolution procedures required by ICANN. The Registrant acknowledges that the outcome of any dispute resolution proceedings may result in the transfer, cancellation, or suspension of the domain name.
5. Data Privacy and WHOIS
The Registrant consents to the collection, use, and publication of their personal data in the WHOIS database as required by ICANN and the relevant Registry. The Registrant acknowledges that this data may be accessed by third parties for purposes consistent with ICANN policies and applicable law.
6. Termination
CloudWorks 360, through its Authorised Registrar, reserves the right to terminate this Agreement and cancel the registration of the Registrant's gTLD if the Registrant breaches any provision of this Agreement or fails to comply with applicable ICANN and Registry policies.
7. Limitation of Liability
CloudWorks 360 and its Authorised Registrar shall not be liable for any loss or damages, whether direct, indirect, incidental, or consequential, arising from the registration, use, or attempted use of a gTLD by the Registrant.
8. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the jurisdiction in which the gTLD is registered.
9. Amendments
CloudWorks 360 reserves the right to amend this Agreement at any time. Any amendments will be effective upon posting on the CloudWorks 360 website, and continued use of the domain name by the Registrant after such posting constitutes acceptance of the revised Agreement.
