Usage and Payment Requirements
- To download or use your "Logo-Maker End Products" (logos created through the CloudWorks 360 Logo-Maker Services) outside of the Website, you must pay the Fee stated on the Website.
- Usage of any Logo-Maker End Products outside the Website without paying the applicable Fees in advance is prohibited.
- Upon payment of the Fee, you may use the Logo-Maker End Products for commercial or personal purposes.
- You must conduct due diligence to ensure the use of the "Logo-Maker Content" (all materials displayed or performed on the Logo-Maker Services) and Logo-Maker End Products are free from adverse claims and not subject to any third-party rights.
Intellectual Property and Usage Restrictions
- The Logo-Maker Content may include materials from third-party providers, and use is at your own risk.
- Abide by all copyright notices and trademark rules. Do not use, copy, reproduce, modify, translate, publish, broadcast, transmit, distribute, perform, upload, display, license, sublicense, rent, lend, assign, gift, sell, or transfer any portion of the Logo-Maker Content or End Products without written consent from the respective owners.
- Some icons, fonts, and symbols might be licensed from third-party providers.
- We and our licensors/providers are not liable for any loss or damage incurred from using any Logo-Maker End Products.
- Use the Logo-Maker End Products only in their entirety; individual elements cannot be used in isolation.
Design Process and Content Ownership
- The final design provided after payment is the only design you have the right to use.
- All other designs shown during the design process are the property of our licensors/providers.
- Grant us and our licensors/providers a non-exclusive license to host the designs created by you.
- We are not responsible for any content lost or unrecoverable through your use of the Logo-Maker Services; back up your designs regularly.
User Responsibilities and Legal Compliance
- You must be at least 18 years old and use the Logo-Maker Services legally.
- Any fraudulent, abusive, or illegal activity may result in termination of your access to the Logo-Maker Services.
- Ensure compliance with local laws, including copyright and trademark laws.
- Do not create Logo-Maker End Products that are pornographic, violent, defamatory, or otherwise violate third-party rights.
Refund Policy
- Fees for Logo-Maker End Products are non-refundable unless determined otherwise at our discretion.
Indemnity
- You agree to indemnify and hold us and our licensors/providers harmless from any claims arising from your use of the Logo-Maker Services or End Products.
Limitation of Liability and Disclaimer
- The Website, Logo-Maker Services, and End Products are provided "as is" without any warranty.
- We and our licensors/providers are not liable for any direct, indirect, incidental, special, punitive, or consequential damages arising from the use of the Logo-Maker Services or End Products.
- Your sole remedy is to stop using the Website, Logo-Maker Services, and Content.
Monitoring and Content Removal
- We do not have a duty to pre-screen Logo-Maker Content but reserve the right to remove any content deemed objectionable or in violation of this Agreement.
Jurisdiction
- Use of the Website and Logo-Maker Services must comply with local laws. Those accessing from jurisdictions prohibiting such use do so at their own risk.
